Terms of Service

The rules for using Toque, its stickers, connected services, and creator tools.

Effective August 2, 2026

These terms form an agreement between you and the operator of the Toque service. By creating an account or using Toque, you agree to these terms. If you do not agree, do not use the service.

1. What Toque provides

Toque lets creators associate an NFC sticker, QR code, RFID identifier, or similar trigger with a server-managed action. A tap or scan can open a link, record an event, add an item to a private list, or ask a connected service to perform an action configured by the creator.

Toque may be offered as a beta or preview. Features can change, and integrations may be limited by a provider, device, browser, network, or physical tag.

3. Stickers and physical placement

You are responsible for owning or having permission to place and program a sticker or code. Do not place one where it could mislead people, damage property, interfere with safety instructions, or trigger an action a reasonable person would not expect.

Test each sticker before deployment. Keep a way to identify and disable it. Toque can change server-side behavior, but cannot retrieve, remove, or repair a physical sticker for you.

4. Your actions, content, and connected accounts

You choose each automation, destination, message, product mapping, and connected account. You represent that you have the rights and permission needed for the content and systems you connect. You remain responsible for reviewing a generated or suggested automation before publishing it.

Keep API keys, webhook credentials, and provider tokens confidential. Do not submit payment card details, government identifiers, health records, or other highly sensitive information unless Toque expressly provides a purpose-built feature for it.

5. Shopping and retailer services

Toque is not a retailer, merchant, delivery service, or payment processor. A shopping tap records an item in the shopper's private Toque list. It does not make a purchase. Where supported, the shopper can later choose to send mapped items to a connected retailer cart.

Product availability, substitutions, price, tax, fees, delivery, checkout, and fulfillment are controlled by the retailer and are subject to its terms. Any comparison or product information is informational and may be delayed or incomplete. Confirm the final retailer cart before purchase.

6. Third-party services

Connected providers, websites, mobile apps, Apple Shortcuts, Android intents, messaging apps, and webhook destinations are operated by others. Their terms and privacy practices apply. Toque does not guarantee that a third-party service will accept, preserve, or complete an action.

You retain your rights in content and configuration you provide. You grant Toque the limited permission needed to host, process, transmit, and display that material to operate, secure, and support the service. Toque and its licensors retain rights in the service, software, design, and documentation.

9. Suspension and termination

You may stop using Toque at any time. Toque may limit or suspend access when reasonably necessary to protect users or systems, investigate misuse, comply with law, address nonpayment in a paid offering, or maintain the service. When practical, notice and an opportunity to correct the issue will be provided.

10. Service availability and changes

Toque may update, add, or remove features. The service is provided on an as-available basis. Maintenance, provider outages, device differences, and network conditions can interrupt an action. Do not use Toque as the only control for emergency, medical, life-safety, access-control, or other high-risk systems.

11. Disclaimers

To the fullest extent permitted by applicable law, the service is provided without warranties of uninterrupted operation, fitness for a particular purpose, or error-free third-party integration. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by applicable law, Toque is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss caused by a third-party service, an unsafe or unauthorized sticker placement, or a configuration you approved. This limitation does not apply where the law does not allow it, including liability that cannot legally be limited.

13. Changes to these terms

Material changes will be posted here with a new effective date and, when reasonably possible, communicated through the service or account channel. Continued use after the effective date means you accept the updated terms.

14. Contact

Signed-in users can review account information in Studio settings. For a legal, safety, or account request, reply through the channel that delivered your Toque invitation or account communication and identify the email used for your account. A dedicated public support address will be published before general self-service signup opens.
